1.1 We are pleased that you are visiting our website and thank you for your interest. Below we inform you about how your personal data is handled when you use our website. Personal data here means all data by which you can be personally identified.
1.2 The controller for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is Hay Plata Group LLC, 1309 Coffeen Avenue STE 1200, 82801 Sheridan, Wyoming, USA, phone: +1 307 2093064, e-mail: site@hayplatapartners.com. The controller for the processing of personal data is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data.
2.1 When you use our website purely for information, that is when you do not register or otherwise transmit information to us, we collect only such data as your browser transmits to the page server (so-called "server log files"). When you access our website, we collect the following data, which is technically necessary for us to display the website to you:
Processing takes place pursuant to Art. 6(1)(f) GDPR on the basis of our legitimate interest in improving the stability and functionality of our website. The data is not passed on or used in any other way. We reserve the right, however, to check the server log files retrospectively should concrete indications point to unlawful use.
2.2 For security reasons and to protect the transmission of personal data and other confidential content (for example orders or enquiries to the controller), this website uses SSL or TLS encryption. You can recognise an encrypted connection by the string "https://" and the padlock symbol in your browser bar.
For hosting our website and displaying the page content we use a provider which supplies its services, itself or through selected subcontractors, exclusively on servers within the European Union.
All data collected on our website is processed on those servers unless different recipients are named below for specific processing operations.
We have concluded a data processing agreement with the provider which ensures the protection of our site visitors' data and prohibits unauthorised disclosure to third parties.
4.1 TidyCal
To provide an online appointment booking function we use the services of the following provider: Sumo Group, Inc., 1345 E. 6th Street Suite 125 Austin, Texas, USA
For the purpose of arranging appointments, first name, surname and e-mail address (and, where a telephone appointment is requested, the telephone number) are collected pursuant to Art. 6(1)(b) GDPR and transmitted to the provider pursuant to Art. 6(1)(f) GDPR on the basis of our legitimate interest in effective customer management and efficient appointment administration, where they are stored for the purpose of organising appointments.
After the appointment has taken place, or after the agreed appointment period has expired, your data is deleted by the provider.
We have concluded a data processing agreement with the provider which ensures the protection of our site visitors' data and prohibits unauthorised disclosure to third parties.
For the transfer of data to the USA the provider relies on standard contractual clauses of the European Commission, which are intended to ensure compliance with the European level of data protection.
4.2 When you contact us (for example via the contact form or by e-mail), personal data is processed exclusively for the purpose of handling and answering your request and only to the extent necessary for that purpose.
The legal basis for processing this data is our legitimate interest in answering your request pursuant to Art. 6(1)(f) GDPR. If your contact is aimed at a contract, the additional legal basis for processing is Art. 6(1)(b) GDPR. Your data is deleted where it can be inferred from the circumstances that the matter concerned has been conclusively settled and provided that no statutory retention obligations stand in the way.
5.1 To perform the contract we work with the service provider or providers named below, who support us wholly or partly in carrying out concluded contracts. Certain personal data is transmitted to these service providers in accordance with the following information.
5.2 Use of payment service providers
If you choose the payment method "Apple Pay" of Apple Distribution International (Apple), Hollyhill Industrial Estate, Hollyhill, Cork, Ireland, payment is processed via the "Apple Pay" function of your device running iOS, watchOS or macOS by debiting a payment card stored in "Apple Pay". Apple Pay uses security functions integrated into the hardware and software of your device to protect your transactions. Authorising a payment therefore requires entry of a code previously defined by you as well as verification by means of the "Face ID" or "Touch ID" function of your device.
For the purpose of payment processing, the information you provide during the ordering process, together with information about your order, is passed on to Apple in encrypted form. Apple then encrypts this data again with a developer-specific key before it is transmitted to the payment service provider of the payment card stored in Apple Pay in order to carry out the payment. The encryption ensures that only the website through which the purchase was made can access the payment data. After the payment has been made, Apple sends your device account number and a transaction-specific dynamic security code to the originating website to confirm that the payment was successful.
Insofar as personal data is processed in the course of the transfers described, processing takes place exclusively for the purpose of payment processing pursuant to Art. 6(1)(b) GDPR.
Apple retains anonymised transaction data, including the approximate purchase amount, the approximate date and time and whether the transaction was completed successfully. Anonymisation completely excludes any reference to a person. Apple uses the anonymised data to improve "Apple Pay" and other Apple products and services.
If you use Apple Pay on the iPhone or Apple Watch to complete a purchase made via Safari on the Mac, the Mac and the authorising device communicate over an encrypted channel on Apple's servers. Apple does not process or store any of this information in a format that identifies you personally. You can deactivate the option of using Apple Pay on your Mac in the settings of your iPhone. Go to "Wallet & Apple Pay" and deactivate "Allow payments on Mac".
Further information on data protection with Apple Pay is available at: https://support.apple.com/de-de/HT203027
If you choose the payment method "Google Pay" of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"), payment is processed via the payment method stored in your Google account.
Authorising a payment via Google Pay on a desktop requires you to log in to your Google account beforehand; on a mobile device it requires completion of the corresponding verification procedure (for example facial recognition, password, fingerprint or pattern).
For the purpose of payment processing, the information you provide during the ordering process, together with information about your order, is passed on to Google. Google then transmits the payment information stored in Google Pay to the originating website in the form of a uniquely assigned transaction number, by which a completed payment is verified. This transaction number contains no information about the actual payment details of the means of payment stored in Google Pay; it is generated and transmitted as a numerical token valid once only. In all transactions via Google Pay, Google acts merely as an intermediary for handling the payment process. The transaction is carried out exclusively in the relationship between the user and the originating website by debiting the means of payment stored in Google Pay.
Insofar as personal data is processed in the course of the transfers described, processing takes place exclusively for the purpose of payment processing pursuant to Art. 6(1)(b) GDPR.
Google reserves the right to collect, store and evaluate certain transaction-specific information for every transaction carried out via Google Pay. This includes the date, time and amount of the transaction, the merchant's location and description, a description of the goods or services purchased provided by the merchant, photographs you have attached to the transaction, the name and e-mail address of the seller and buyer or of the sender and recipient, the payment method used, your description of the reason for the transaction and, where applicable, the offer associated with the transaction.
According to Google, this processing takes place exclusively pursuant to Art. 6(1)(f) GDPR on the basis of the legitimate interest in proper invoicing, the verification of transaction data and the optimisation and maintenance of the Google Pay service.
Google further reserves the right to combine the processed transaction data with other information collected and stored by Google when other Google services are used.
The terms of use of Google Pay are available here:

The provider processes various data, the scope of the data processed depending on which data you communicate before or during participation in an online meeting, video conference or webinar. This may include in particular your registration data (name, e-mail address, telephone number (optional) and password) and session data (topic, participant IP address, device information, description (optional)).
In addition, image and sound contributions from participants as well as voice input in chats may be processed.
For the processing of personal data necessary for the performance of a contract with you (this also applies to processing operations necessary for carrying out pre-contractual measures), Art. 6(1)(b) GDPR serves as the legal basis. Insofar as you have given us consent to process your data, processing takes place on the basis of Art. 6(1)(a) GDPR. You may withdraw consent given at any time with effect for the future.
Otherwise, the legal basis for data processing when holding online meetings, video conferences or webinars is our legitimate interest pursuant to Art. 6(1)(f) GDPR in the effective holding of the online meeting, webinar or video conference.
We have concluded a data processing agreement with the provider which ensures the protection of our site visitors' data and prohibits unauthorised disclosure to third parties.
For data transfers to the USA the provider has joined the EU-US Data Privacy Framework, which on the basis of an adequacy decision of the European Commission ensures compliance with the European level of data protection.
7.1 Applicable data protection law grants you the following data subject rights (rights to information and intervention) vis-à-vis the controller with regard to the processing of your personal data, reference being made to the legal basis cited for the respective conditions of exercise:
7.2 RIGHT TO OBJECT
WHERE WE PROCESS YOUR PERSONAL DATA ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST IN THE COURSE OF A BALANCING OF INTERESTS, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THAT PROCESSING WITH EFFECT FOR THE FUTURE ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION.
IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL CEASE PROCESSING THE DATA CONCERNED. FURTHER PROCESSING REMAINS RESERVED, HOWEVER, WHERE WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR WHERE THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS.
WHERE YOUR PERSONAL DATA IS PROCESSED BY US FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSES OF SUCH MARKETING. YOU MAY EXERCISE THE OBJECTION AS DESCRIBED ABOVE.
IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL CEASE PROCESSING THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.
The duration of storage of personal data is determined by the respective legal basis, the purpose of processing and, where relevant, additionally by the applicable statutory retention period (for example retention periods under commercial and tax law).
Where personal data is processed on the basis of express consent pursuant to Art. 6(1)(a) GDPR, the data concerned is stored until you withdraw your consent.
Where statutory retention periods exist for data processed in the course of legal or quasi-legal obligations on the basis of Art. 6(1)(b) GDPR, that data is routinely deleted after the retention periods have expired, provided it is no longer required for the performance or initiation of a contract and/or we no longer have a legitimate interest in continued storage.
Where personal data is processed on the basis of Art. 6(1)(f) GDPR, that data is stored until you exercise your right to object pursuant to Art. 21(1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
Where personal data is processed for direct marketing purposes on the basis of Art. 6(1)(f) GDPR, that data is stored until you exercise your right to object pursuant to Art. 21(2) GDPR.
Unless otherwise stated in the other information in this notice concerning specific processing situations, stored personal data is otherwise deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
When you purchase our digital dossier, the contract of sale is concluded not with us but with Sold through Link, LLC. That company acts as what is known as the merchant of record, that is, as the seller in the legal sense. It processes the payment, issues the invoice and remits the value added tax due. Payment processing within the European Economic Area is carried out by the responsible Stripe entity; the information given in the Stripe section applies accordingly.
For the data processed in this context — in particular name, e-mail address, billing address, payment data, tax amounts and information on refunds and chargebacks — the merchant of record acts as a controller in its own right within the meaning of Art. 4(7) GDPR and not as a processor on our behalf. Its own data protection provisions therefore govern that processing.
We ourselves process in this context only the data required to deliver the purchased content and to answer related enquiries. The legal basis is Art. 6(1)(b) GDPR.
