1) Scope

1.1 These general terms and conditions (the "Terms") of Hay Plata Group LLC (the "Provider") apply to all contracts which a consumer or trader (the "Customer") concludes with the Provider regarding the services described by the Provider on its website or in other media. The inclusion of the Customer's own terms is hereby objected to unless otherwise agreed.

1.2 A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

1.3 A trader within the meaning of these Terms is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its trade, business or profession.

2) Conclusion of contract

2.1 The service descriptions on the Provider's website do not constitute binding offers by the Provider; they serve to enable the Customer to submit a binding offer.

2.2 The Customer may submit the offer via the online order form integrated into the Provider's website. Having placed the selected services in the virtual basket and passed through the electronic ordering process, the Customer submits a legally binding contractual offer in respect of the services contained in the basket by clicking the button that completes the ordering process.

2.3 The Provider may accept the Customer's offer within five days,

  • by sending the Customer a written order confirmation or an order confirmation in text form (fax or e-mail), receipt of the order confirmation by the Customer being decisive, or
  • by beginning to perform the service at the Customer's request and notifying the Customer of this, or
  • by requesting payment from the Customer after the order has been placed.

Where more than one of the above alternatives applies, the contract is concluded at the point in time at which one of them first occurs. The period for accepting the offer begins on the day after the Customer sends the offer and ends at the end of the fifth day following that date. If the Provider does not accept the Customer's offer within that period, this is deemed a rejection of the offer, with the result that the Customer is no longer bound by their declaration of intent.

2.4 Where an offer is submitted via the Provider's online order form, the Provider stores the text of the contract after the contract has been concluded and sends it to the Customer in text form (for example by e-mail, fax or letter) after the Customer's order has been placed. The Provider does not make the text of the contract accessible beyond this.

2.5 Before placing a binding order via the Provider's online order form, the Customer can identify possible input errors by reading the information displayed on screen carefully. The browser's zoom function, which enlarges the display on screen, can be an effective technical means of identifying input errors. Within the electronic ordering process, the Customer can correct their entries using the usual keyboard and mouse functions until they click the button that completes the ordering process.

2.6 German is available for the conclusion of the contract.

2.7 Order processing is generally carried out automatically by e-mail. The Customer must ensure that the e-mail address they provide for order processing is correct, so that e-mails sent by the Provider can be received at that address.

3) Right of withdrawal

Consumers are in principle entitled to a right of withdrawal. Further information on the right of withdrawal can be found in the Provider's instruction on withdrawal.

4) Cancellation of appointments

4.1 Irrespective of any statutory right of withdrawal, the Provider grants the Customer the right to cancel an appointment for a service of the Provider free of charge on the following terms (contractual right of cancellation):

4.2 The Customer may cancel their appointment up to 2 days before the booked service begins, without giving reasons, by a declaration made to the Provider in text form (for example by e-mail). Receipt of the declaration by the Provider is decisive for compliance with the cancellation period. If the Customer cancels the appointment in good time, the Provider will refund any fee already paid in full within two weeks of receiving the declaration. The Provider may use the same means of payment that the Customer used to pay the Provider.

4.3 Any statutory right of withdrawal the Customer may have is not restricted by the right of cancellation set out above.

5) Prices and payment terms

5.1 Unless otherwise stated in the Provider's offer, the prices quoted are total prices including statutory value added tax.

5.2 Where a payment method offered via the payment service "Stripe" is selected, payment is processed by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland ("Stripe"). Stripe may use further payment services to process payments, for which special payment terms may apply and to which the Customer may be referred separately. Further information on Stripe is available at https://stripe.com/de.

5.3 Where a payment method offered via the payment service "Google Pay" is selected, payment is processed by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"). Google may use further payment services to process payments, for which special payment terms may apply and to which the Customer may be referred separately. Further information on Google Pay is available at https://pay.google.com/intl/de_de/about/.

Further information on Apple Pay is available at https://www.apple.com/de/apple-pay/.

6) Alternative dispute resolution

The Provider is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
